1. Acceptance of Terms

By accessing or using GenPush ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Definitions

  • "Account" means the user profile required to access the Services, created by registering at genpush.ai
  • "Brand" means your trademark and associated visual identity submitted for use with the Services
  • "Credits" means virtual credits enabling you to generate and download Content
  • "Content" means all marketing materials (text, images, ads, social media posts) generated through the Services
  • "Services" means GenPush's AI-powered content creation platform enabling you to generate Content
  • "Subscription" means your enrollment and agreement to pay fees for ongoing access to the Services

3. Description of Service

GenPush is a web-based AI-powered platform that allows users to generate social media posts, ads, and carousel content. The Service includes features such as AI image generation, AI copywriting, brand management, image library storage, and export functionality.

4. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

5. Subscriptions and Payment

The Service is offered on a subscription basis. By subscribing, you agree to:

  • Pay the subscription fee at the start of each billing period
  • Automatic renewal unless you cancel before the end of the current period
  • Credits do not roll over between billing periods

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

6. Refund Policy

All sales are final. We do not offer refunds.

Due to the high costs of AI image generation, we cannot provide refunds for any subscription payments. Our upstream providers charge us for GPU processing time whenever you generate an image, and these costs cannot be recovered once incurred.

By subscribing to the Service, you acknowledge and agree to this no-refund policy.

You may cancel your subscription at any time to prevent future charges. Your subscription will remain active until the end of your current billing period, and you will not be charged again.

7. Data Retention and Deletion

Important: If your subscription is canceled or expires:

  • Your account access will be limited to viewing only
  • You will not be able to create new content or generate new images
  • Your data (including all images, projects, and files) will be permanently deleted 90 days after your subscription ends
  • If you resubscribe within 90 days, your data will be preserved
  • After 90 days, deleted data cannot be recovered

We recommend downloading any content you wish to keep before your subscription ends.

8. Intellectual Property and Content Ownership

Our Property. All Services, including software, algorithms, and platform elements, remain our exclusive property.

Your Content. You retain ownership of content you upload and content you create using the Service, including AI-generated images. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Non-Exclusivity. Due to the nature of AI, generated Content may not be unique and similar results may be generated for other users. You acknowledge that other users may receive substantially similar or identical Content.

9. Acceptable Use

You shall not, and shall not permit any third party to:

  • Generate illegal, harmful, or offensive content
  • Generate sexually explicit or pornographic content
  • Infringe on the intellectual property rights of others
  • Copy, reproduce, modify, distribute, or reverse engineer the Services
  • Resell, sublicense, or otherwise make the Services available to third parties without prior written consent
  • Distribute malware or engage in phishing
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its systems

We reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate any Account at any time and without prior notice if we determine that content or usage violates these Terms, applicable laws, or our content policies. Such enforcement actions may be taken immediately and without liability to you.

10. AI-Generated Content

AI-generated content is created using machine learning models. While we strive for quality, we do not guarantee that AI-generated content will be accurate, complete, or suitable for any particular purpose. Specifically:

  • AI-generated ad copy, social media posts, captions, and images may contain errors, inaccuracies, or misleading claims
  • AI-generated images may unintentionally resemble copyrighted material, trademarks, or real individuals
  • Generated content may not comply with advertising regulations, platform policies, or industry-specific rules applicable to your business
  • We do not verify the factual accuracy of any AI-generated text or claims

You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing, distributing, or using it in any way. By using the Service, you agree that GenPush bears no responsibility or liability for any consequences arising from your use of AI-generated content, including but not limited to:

  • False or misleading advertising claims
  • Intellectual property or trademark infringement
  • Violations of advertising platform policies (e.g. Facebook, Google, Instagram, LinkedIn)
  • Regulatory non-compliance in your jurisdiction or industry
  • Any damages, fines, or losses resulting from published AI-generated content

You agree to indemnify and hold GenPush harmless from any claims, damages, or expenses arising from your use or publication of AI-generated content created through the Service.

11. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or that defects will be corrected. We make no warranty that the Services will meet your specific requirements or expectations.

12. Limitation of Liability

To the maximum extent permitted by law, GenPush shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability arising out of or related to the Services shall not exceed the total fees paid by you to us during the six (6) months immediately preceding the event giving rise to the claim.

13. Modifications to Services

We reserve the right, at any time and in our sole discretion, to modify, update, suspend, or discontinue any part of the Services, including features, functionality, pricing, subscription plans, and credit systems. Such modifications may include changes to the way credits are earned, used, allocated, or limited. Continued use of the Services after such changes constitutes acceptance of the updated Services.

14. Termination

By You. You may terminate at any time subject to the cancellation requirements in Section 5.

By Us. We may suspend or terminate your access for breach of these Terms, non-payment, illegal or harmful use, or violation of third-party rights. We may do so at our sole discretion and without prior notice.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.

16. General Provisions

  • Governing Law. These Terms are governed by the laws of England and Wales without regard to conflict of law provisions.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Assignment. You may not assign or transfer these Terms or your Account without our prior written consent.
  • Force Majeure. Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
  • Entire Agreement. These Terms constitute the entire agreement between the parties regarding the use of the Services.
